These Terms govern your use of our hosting services and website and constitute a legally binding agreement between you and Shabaka IT. By using our services, you agree to be bound by these Terms. 1. Hosting Services

1.1 Description of Services: Shabaka IT provides web hosting services, which include server space, bandwidth, and other related services necessary for hosting websites.

1.2 Eligibility: To use our services, you must be at least 18 years old or have the legal capacity to enter into a binding contract. By using our services, you represent and warrant that you meet these eligibility requirements.

1.3 Account Creation: In order to access our hosting services, you may be required to create an account. You are responsible for providing accurate and complete information during the registration process. You are also responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

1.4 Acceptable Use: You agree to use our hosting services in compliance with all applicable laws, regulations, and these Terms. You will not use our services for any illegal, fraudulent, or unauthorized purposes, and you will not interfere with or disrupt the operation of our servers or networks.

2. Payment and Billing

2.1 Fees: The fees for our hosting services are outlined on our website or provided to you separately. You agree to pay all applicable fees associated with your use of our services.

2.2 Billing and Payment: We may offer various payment options, and you agree to provide accurate and complete payment information. By providing your payment information, you authorize us to charge the specified fees using the selected payment method. Payments are due as specified in the invoice or payment terms.
If a shared hosting account has a past due invoice, we will perform the following actions.
1-3 Days – No Action Taken
4 Days – Accounts are suspended
7 Days – Late Fee Added
30 Days – Accounts will be terminated.
There will be a BDT 2000.00 fee to reinstate accounts that have been suspended/terminated.

2.3 Automatic Renewal: If you choose a subscription-based plan, your hosting services will automatically renew at the end of each billing cycle unless you cancel your subscription before the renewal date. You are responsible for timely cancelling your subscription to avoid automatic renewal.

3. Intellectual Property

3.1 Ownership: We retain all right, title, and interest in and to our hosting services, including all intellectual property rights. Nothing in these Terms grants you any right or license to use our trademarks, logos, or other proprietary information.

3.2 User Content: By using our hosting services, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, and distribute any content you upload or transmit through our servers. You represent and warrant that you have the necessary rights and permissions to grant us this license.

4. Data Backup and Security

4.1 Data Backup: While we strive to maintain data backups, you are solely responsible for regularly backing up your website content and data. We recommend keeping independent backups to safeguard your information.

4.2 Security: We implement reasonable security measures to protect your data and maintain the confidentiality of your account information. However, you acknowledge that no method of transmission or storage can be guaranteed as completely secure.

5. Limitation of Liability

5.1 Disclaimer: Our hosting services are provided on an “as-is” and “as available” basis. We make no warranties, express or implied, regarding the reliability, accuracy, availability, or suitability of our services for your specific purposes.

5.2 Limitation of Liability: In no event shall Shabaka IT be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.

6. Termination

6.1 Termination by You: You may terminate your hosting services at any time by canceling your account in accordance with our cancellation procedures.

6.2 Termination by Us: We may terminate or suspend your hosting services without prior notice if you breach these Terms or if we have reasonable grounds to believe that your use of our services violates applicable laws or poses a risk to the security or integrity of our systems.

7. General Provisions

7.1 Modifications: We reserve the right to modify these Terms at any time. Any changes will be effective upon posting the revised Terms on our website. Your continued use of our services after the posting of the revised Terms constitutes your acceptance of the updated Terms.
